Who We Are and Acceptance of These Terms

This website, fitfoathletics.com (the "Site"), is operated by FITFO Athletics LLC, a Nevada limited liability company based in Las Vegas, Nevada ("FITFO Athletics," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site, including browsing, creating an account, and purchasing products. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live, to place an order on the Site. If you create an account, you are responsible for keeping your login information confidential and for all activity under your account. You agree to provide accurate and current information when you create an account or place an order.

Products, Pricing, and Errors

We work to describe and price products accurately, but errors can happen, including mispriced items, inaccurate descriptions, and stock errors. All prices on the Site are listed in United States Dollars (USD) and may change at any time. If we find an error in your order, including a pricing or stock error, we may cancel the order or the affected part of it. If we cancel any part of your order, we will refund in full any amount you were charged for the canceled portion.

Orders, Acceptance, and Payment

Placing an order is an offer to purchase, which we may accept or decline. We may decline or cancel an order for reasons that include suspected fraud, a pricing or stock error, or a violation of these Terms. No contract of sale is formed until we confirm your order, such as by sending a shipping confirmation. Payment is collected at the time of order through the payment methods available on the Site. You represent that any payment information you provide is accurate and that you are authorized to use the payment method.

Shipping and Returns

Our Shipping Policy explains where we ship, processing and delivery times, shipping rates, and what to do if a package is lost, delayed or damaged. Returns are described in our Refund Policy. In summary, you may request a return within 30 days of delivery if the item is unworn and unused with tags attached, for orders shipped within the United States. Promotions and Discount Codes

We may offer discount codes and other promotions from time to time. Unless we state otherwise, a code applies only as described when it was issued, has no cash value, and cannot be combined with other offers. We may limit, modify, or end a promotion at any time without notice, and we may cancel or adjust an order if we reasonably believe a code or promotion was used in error or in violation of its terms or these Terms.

Marketing Emails and Text Messages

If you sign up for marketing emails or check a text-message marketing box on the Site or at checkout, you agree to receive marketing messages from FITFO Athletics at the email address or phone number you provide. Text messages may include order updates, new drops, restocks and offers.

FITFO, the FITFO logo, "Figure It The FK Out," and other names, marks, and content on the Site are trademarks, trade dress, or other intellectual property of FITFO Athletics LLC or its licensors, unless we say otherwise. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial shopping. You may not copy, reproduce, modify, distribute, or otherwise use our trademarks or other content without our prior written permission.

Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. Changes take effect when we post them to this page, and your continued use of the Site after that means you accept the updated Terms. We encourage you to review this page from time to time.

General

If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and FITFO Athletics LLC about the Site, and replace any earlier agreements on that subject. We are not responsible for a delay or failure caused by an event beyond our reasonable control, including a natural disaster, labor dispute, shipping carrier delay, or supply chain disruption. The sections of these Terms that by their nature should continue after your access to the Site ends, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law and Venue, will continue.
